Article 1: Acceptance of the Terms and Conditions for Use of Products and Services

Welcome to GMS. This website is operated by GMS. Please carefully read these Terms and Conditions before using or registering on this website. The website https://globalmemorysupply.com/ and all products and services displayed on it are owned by GMS. By accessing the website and using the products and services described at https://globalmemorysupply.com/, you agree to be bound by the provisions of this Terms of Use Agreement.

Based on business practices and applicable laws, we reserve the right to modify, update, supplement, or remove part or all of these terms at any time without direct notice to you. Such changes will be publicly posted on the GMS website.

You agree that your continued access to the website and use of products and services after any updates or amendments to this Terms of Use Agreement constitutes your acceptance of the revised agreement.

If any provision of this Terms of Use conflicts with applicable law and is declared invalid by a court, such provision shall be deemed unenforceable and amended to comply with current law, while the remaining provisions shall remain in full force and effect.

Article 2: Definitions

“GMS”, “We”, “Us”: GMS.

“You”, “Customer”: Any individual accessing this website and/or lawfully purchasing or using products and services provided by GMS, and having ownership rights to such products and services in accordance with applicable law.

“GMS Products and Services”: Products and services listed on this website.

Article 3: Prohibited Conduct

When accessing the website and/or using our products and services, you are prohibited from:

  • Using purchased products or services for any purpose or in any manner that violates Vietnamese law.
  • Using products or services in a way that harms or may harm minors in any form.
  • Sending, linking, or transmitting unlawful, state-prohibited, threatening, defamatory, fraudulent, inflammatory, hateful, divisive, obscene, immoral, or offensive content; or content that discloses state, military, security, economic, diplomatic, or other legally protected secrets.
  • Storing or transmitting data that may constitute or encourage legal violations, copyright or intellectual property infringement, trade secret violations, or infringement of lawful rights of other individuals or organizations.
  • Uploading, posting, emailing, or transmitting materials containing viruses or malicious code designed to disrupt, damage, or limit hardware, software, or telecommunications functions.
  • Engaging in fraud or violating these terms or applicable laws in connection with linked websites or service providers.
  • Impersonating any person or entity, including GMS employees, or misrepresenting affiliation.
  • Using services beyond allocated resource limits or violating service-specific regulations as set out in Article 16.
  • Interfering with services, servers, or networks connected to the service.
  • Violating anti-spam regulations under Decree 90/2008/ND-CP or applicable legal documents.
  • Violating regulations of the Ministry of Information and Communications or other applicable Vietnamese laws regarding internet use.

Article 4: Rights and Obligations of Customers

As a customer, you have full rights and obligations of a buyer, lessee, and user under the Civil Code, Commercial Law of Vietnam, and other relevant laws.

You must have full legal capacity to enter into contracts with GMS and confirm that you are not legally incapacitated or restricted, not bound by court judgments or prohibited from engaging in transactions related to GMS’s products and services.

You are legally responsible for the purpose of use and accuracy of information provided. If GMS requests verification, you must provide accurate and timely information.

You are directly responsible for managing and maintaining your products and services and bear responsibility for consequences arising from violations or mismanagement.

You must notify GMS in writing of any changes in transactional information (name, address, tax code, contact details, etc.). GMS shall not be liable for consequences arising from failure to comply.

Within 30 days of successful service registration, you must submit required documents (service contract, ID copy for individuals, or stamped contract for organizations, and other documents as required). Failure to do so may result in service suspension without refund.

You must notify the Ministry of Information and Communications when using non-.VN domains as required by law.

For international domain registrations, you must verify declared information via the admin email within 15 days in accordance with ICANN regulations.

You are responsible for maintaining account and password confidentiality and must notify GMS immediately of any unauthorized use.

Article 5: Rights and Responsibilities of GMS

As a service provider, GMS has full rights and obligations under Vietnamese law.

GMS commits to supporting customers during service use.

GMS may require information verification if fraudulent or inaccurate information is suspected.

Depending on the severity of violations, GMS may suspend, terminate services under Article 8 and/or report to competent authorities.

Article 6: Payment Regulations

By registering for services, you agree to comply with our payment guidelines

GMS is not liable for any consequences arising from your failure to comply with payment regulations.

Article 7: Service Renewal

Customers must proactively monitor service status and expiration dates.

Service renewal is effective only upon full payment and will be completed within 1 day after payment is received.

Payment deadlines before expiration:

  • .VN and international domains: 30 days prior to expiration.
  • Server services (Dedicated, Colocation, VPS, Cloud, Hosting, Email, Rack, DC, DR, Tape Offsite, Bandwidth, etc.): 15 days prior.
  • Licensed software rental: 15 days prior.
  • Cloud PBX / Cloud CC: 15 days prior.

GMS is not liable for damages arising from failure to renew on time.

Article 8: Suspension and Termination

Services may automatically terminate upon contract expiration or mutual agreement.

GMS may suspend or terminate services if:

  • You violate Article 3.
  • You fail to provide required documents under Article 4.
  • You fail to renew and pay fees within 15 days after expiration.

Article 9: Information Updates During Service Use

Customer information updates will be processed within 24 hours after receiving valid requests via email or other methods.

Applicable updates include:

  • Incorrect or incomplete customer information.
  • Service specifications inconsistent with website description (within 30 days of new registration).
  • Confirmation email not received despite payment.

GMS is not liable for consequences arising from non-compliance.

Article 10: Customer Support

GMS is not responsible for third-party complaints related to your use of services.

Technical support is provided to designated administrators.

Support requests can be made via hotline 19006891 or phone 024 7305 6666 – 028 7308 6666 after you have attempted self-troubleshooting.

Article 11: Limitation of Liability and Disclaimer

GMS is not responsible for your access devices or transmission equipment.

GMS does not guarantee uninterrupted service or immunity from third-party attacks, viruses, or external disruptions.

Customers must back up all data stored on GMS servers. GMS is not liable for data loss or related damages.

You agree to indemnify GMS against any legal claims, costs, or damages arising from your violations.

GMS shall not be liable for indirect, consequential, or intangible damages including loss of profit, reputation, or data.
